s\u2019acquitter de ses obligation, n\u2019\u00e9tablissait pas que les titres litigieux n\u2019auraient pas \u00e9t\u00e9 pay\u00e9s, la cour d\u2019appel a invers\u00e9 la charge de la preuve et viol\u00e9 les textes susvis\u00e9s<\/strong><\/span><\/p>\n<h1 style=\"text-align: left;\">01-10.612<br \/>\nArr\u00eat n\u00b0\u00a0930 du 3 juin 2003<br \/>\nCour de cassation &#8211; Chambre commerciale<\/h1>\n<p style=\"text-align: left;\">CH\u00c8QUE<\/p>\n<h3 style=\"text-align: left;\">Cassation<\/h3>\n<div style=\"text-align: left;\"><\/div>\n<hr \/>\n<p style=\"text-align: left;\"><em>Demandeur(s) \u00e0 la cassation\u00a0: M.\u00a0Areski X&#8230;<br \/>\nD\u00e9fendeur(s) \u00e0 la cassation\u00a0: Mme\u00a0Arlette Y&#8230; et autres<\/em><\/p>\n<hr \/>\n<p style=\"text-align: left;\">Attendu, selon l\u2019arr\u00eat attaqu\u00e9, que Mme\u00a0Y&#8230;, propri\u00e9taire de locaux \u00e0 usage commercial donn\u00e9s en location \u00e0 M.\u00a0X&#8230;, lui a fait d\u00e9livrer le 11\u00a0ao\u00fbt\u00a01999, un commandement de payer une somme \u00e0 titre de loyers en visant la clause r\u00e9solutoire pr\u00e9vue par le bail\u00a0; que le 17\u00a0ao\u00fbt\u00a01999, M.\u00a0X&#8230; a remis \u00e0 l\u2019huissier instrumentaire deux ch\u00e8ques couvrant l\u2019int\u00e9gralit\u00e9 des causes de ce commandement en demandant d\u2019en diff\u00e9rer l\u2019encaissement aux 15\u00a0septembre et 10\u00a0octobre\u00a01999\u00a0; que Mme\u00a0Y&#8230;, qui estimait que son locataire n\u2019avait pas acquitt\u00e9 les causes du commandement dans le d\u00e9lai d\u2019un mois qui expirait le 12\u00a0septembre\u00a01999, a sollicit\u00e9 du juge des r\u00e9f\u00e9r\u00e9s qu\u2019il constate l\u2019acquisition \u00e0 son profit de la clause r\u00e9solutoire\u00a0;<\/p>\n<p style=\"text-align: left;\"><strong>Sur le moyen unique, pris en sa premi\u00e8re branche\u00a0:<\/strong><\/p>\n<p style=\"text-align: left;\">Vu l\u2019article\u00a028 du d\u00e9cret-loi du 30\u00a0octobre 1935 devenu l\u2019article\u00a0L.\u00a0131-31 du Code mon\u00e9taire et financier\u00a0;<\/p>\n<p style=\"text-align: left;\">Attendu que pour accueillir cette pr\u00e9tention, l\u2019arr\u00eat retient qu\u2019il r\u00e9sultait des dates d\u2019encaissement demand\u00e9s par M.\u00a0X&#8230; que celui-ci n\u2019entendait pas r\u00e9gler les causes du commandement dans le d\u00e9lai d\u2019un mois expirant le 12\u00a0septembre\u00a01999\u00a0;<\/p>\n<p style=\"text-align: left;\">Attendu qu\u2019en statuant ainsi, alors que les ch\u00e8ques litigieux non refus\u00e9s lors de leur remise, \u00e9taient payables \u00e0 vue nonobstant toute mention contraire, r\u00e9put\u00e9e non \u00e9crite, la cour d\u2019appel a viol\u00e9 le texte susvis\u00e9\u00a0;<\/p>\n<p style=\"text-align: left;\"><strong>Et sur le moyen unique, pris en sa deuxi\u00e8me branche\u00a0:<\/strong><\/p>\n<p style=\"text-align: left;\">Vu les articles\u00a028 et 34 du d\u00e9cret-loi du 30\u00a0octobre\u00a01935, devenus les articles\u00a0L.\u00a0131-31 et L.\u00a0131-37 du Code mon\u00e9taire et financier, ensemble l\u2019article\u00a01315 du Code civil\u00a0;<\/p>\n<p style=\"text-align: left;\">Attendu que pour statuer comme il a fait, l\u2019arr\u00eat retient encore que M.\u00a0X&#8230; ne d\u00e9montrait pas qu\u2019il disposait des fonds n\u00e9cessaires pour s\u2019acquitter de ses obligations dans le d\u00e9lai du commandement\u00a0;<\/p>\n<p style=\"text-align: left;\">Attendu qu\u2019en statuant ainsi alors que,\u00a0faute de les avoir pr\u00e9sent\u00e9s au paiement, Mme\u00a0Y&#8230;, \u00e0 qui il incombait de le prouver, n\u2019\u00e9tablissait pas que les titres litigieux n\u2019auraient pas \u00e9t\u00e9 pay\u00e9s, la cour d\u2019appel a invers\u00e9 la charge de la preuve et viol\u00e9 les textes susvis\u00e9s\u00a0;<\/p>\n<p style=\"text-align: left;\"><strong>PAR CES MOTIFS<\/strong>\u00a0et sans qu\u2019il y ait lieu de statuer sur les autres griefs\u00a0:<\/p>\n<p style=\"text-align: left;\">CASSE ET ANNULE, dans toutes ses dispositions, l\u2019arr\u00eat rendu le 1er\u00a0f\u00e9vrier\u00a02001, entre les parties, par la cour d\u2019appel d\u2019Orl\u00e9ans\u00a0; remet, en cons\u00e9quence, la cause et les parties dans l\u2019\u00e9tat o\u00f9 elles se
