l\u2019article\u00a01er\u00a0de la Constitution n\u2019est pas applicable aux salari\u00e9s des employeurs de droit priv\u00e9 qui ne g\u00e8rent pas un service public.<\/strong><\/span><\/div>\n<div style=\"text-align: left;\"><span style=\"color: #ff0000;\"><strong>\u00a0il ne peut d\u00e8s lors \u00eatre invoqu\u00e9 pour les priver de la protection que leur assurent les dispositions du code du travail\u00a0<\/strong><\/span><\/div>\n<div style=\"text-align: left;\"><span style=\"color: #ff0000;\"><strong>il r\u00e9sulte des articles L. 1121-1, L. 1132-1, L. 1133-1 et L. 1321-3 du code du travail que les restrictions \u00e0 la libert\u00e9 religieuse doivent \u00eatre justifi\u00e9es par la nature de la t\u00e2che \u00e0 accomplir, r\u00e9pondre \u00e0 une exigence professionnelle sa premi\u00e8re branche\u00a0:<\/strong><\/p>\n<p style=\"text-align: left;\">Vu les articles L. 1121-1, L. 1132-1, L. 1133-1 et L. 1321-3 du code du travail, ensemble l\u2019article 9 de la Convention de sauvegarde des droits de l\u2019homme et des libert\u00e9s fondamentales\u00a0;<\/p>\n<p style=\"text-align: left;\">Attendu que le principe de la\u00efcit\u00e9 instaur\u00e9 par l\u2019article\u00a01er\u00a0de la Constitution n\u2019est pas applicable aux salari\u00e9s des employeurs de droit priv\u00e9 qui ne g\u00e8rent pas un service public\u00a0; qu\u2019il ne peut d\u00e8s lors \u00eatre invoqu\u00e9 pour les priver de la protection que leur assurent les dispositions du code du travail\u00a0; qu\u2019il r\u00e9sulte des articles L. 1121-1, L. 1132-1, L. 1133-1 et L. 1321-3 du code du travail que les restrictions \u00e0 la libert\u00e9 religieuse doivent \u00eatre justifi\u00e9es par la nature de la t\u00e2che \u00e0 accomplir, r\u00e9pondre \u00e0 une exigence professionnelle essentielle et d\u00e9terminante et proportionn\u00e9es au but<br \/>\nrecherch\u00e9\u00a0;<\/p>\n<p style=\"text-align: left;\">Attendu, selon l\u2019arr\u00eat attaqu\u00e9, que, suivant contrat \u00e0 dur\u00e9e ind\u00e9termin\u00e9e du\u00a01er\u00a0janvier 1997, lequel faisait suite \u00e0 un emploi solidarit\u00e9 du 6 d\u00e9cembre 1991 au 6 juin 1992 et \u00e0 un contrat de qualification du\u00a01er\u00a0d\u00e9cembre 1993 au 30 novembre 1995, Mme\u00a0X&#8230; \u00e9pouse Y&#8230; a \u00e9t\u00e9 engag\u00e9e en qualit\u00e9 d\u2019\u00e9ducatrice de jeunes enfants exer\u00e7ant les fonctions de directrice adjointe de la cr\u00e8che et halte-garderie g\u00e9r\u00e9e par l\u2019association\u00a0Baby\u00a0Loup\u00a0; qu\u2019ayant b\u00e9n\u00e9fici\u00e9 en mai 2003 d\u2019un cong\u00e9 maternit\u00e9 suivi d\u2019un cong\u00e9 parental jusqu\u2019au 8 d\u00e9cembre 2008, elle a \u00e9t\u00e9 convoqu\u00e9e par lettre du 9 d\u00e9cembre 2008 \u00e0 un entretien pr\u00e9alable en vue de son \u00e9ventuel licenciement, avec mise \u00e0 pied \u00e0 titre conservatoire, et licenci\u00e9e le 19 d\u00e9cembre 2008 pour faute grave aux motifs notamment qu\u2019elle avait contrevenu aux dispositions du r\u00e8glement int\u00e9rieur de l\u2019association en portant un voile islamique\u00a0; que, s\u2019estimant victime d\u2019une discrimination au regard de ses convictions religieuses, Mme\u00a0X&#8230; \u00e9pouse Y&#8230; a saisi la juridictionprud\u2019homale\u00a0le 9 f\u00e9vrier 2009, \u00e0 titre principal, en nullit\u00e9 de son licenciement\u00a0;<\/p>\n<p style=\"text-align: left;\">Attendu que, pour dire le licenciement fond\u00e9 et rejeter la demande de nullit\u00e9 du licenciement, l\u2019arr\u00eat retient que les statuts de l\u2019association pr\u00e9cisent que celle-ci a pour but de d\u00e9velopper une action orient\u00e9e vers la petite enfance en milieu d\u00e9favoris\u00e9 et d\u2019oeuvrer pour l\u2019insertion sociale et professionnelle des femmes du quartier, qu\u2019elle s\u2019efforce de r\u00e9pondre \u00e0 l\u2019ensemble des besoins collectifs \u00e9manant des familles, avec comme objectif la revalorisation de la vie locale, sur le plan professionnel, social et culturel sans distinction d\u2019opinion politique ou confessionnelle, que conform\u00e9ment \u00e0 ces dispositions la cr\u00e8che doit assurer une neutralit\u00e9 du personnel d\u00e8s lors qu\u2019elle a pour vocation d\u2019accueillir tous les enfants du quartier quelle que soit leur appartenance culturelle ou religieuse, que ces enfants, compte tenu de leur jeune \u00e2ge, n\u2019ont pas \u00e0 \u00eatre confront\u00e9s \u00e0 des manifestations ostentatoires d\u2019appartenance religieuse, que tel est le sens des dispositions du r\u00e8glement int\u00e9rieur entr\u00e9 en vigueur le 15 juillet 2003, lequel, au titre des r\u00e8gles g\u00e9n\u00e9rales et permanentes relatives \u00e0 la discipline au sein de l\u2019association, pr\u00e9voit que le principe de la libert\u00e9 de conscience et de religion de chacun des membres du personnel ne peut faire obstacle au respect des principes de la\u00efcit\u00e9 et de neutralit\u00e9 qui s\u2019appliquent dans l\u2019exercice de l\u2019ensemble des activit\u00e9s d\u00e9velopp\u00e9es par\u00a0Baby\u00a0Loup, tant dans les locaux de la cr\u00e8che ou ses annexes qu\u2019en accompagnement ext\u00e9rieur des enfants confi\u00e9s \u00e0 la cr\u00e8che, que les restrictions ainsi pr\u00e9vues apparaissent d\u00e8s lors justifi\u00e9es par la nature de la t\u00e2che \u00e0 accomplir et proportionn\u00e9es au but recherch\u00e9 au sens des articles L. 1121-1 et L. 1321-3 du code du travail, qu\u2019il r\u00e9sulte des pi\u00e8ces fournies, notamment de l\u2019attestation d\u2019une \u00e9ducatrice de jeunes enfants, que la salari\u00e9e, au titre de ses fonctions, \u00e9tait en contact avec les enfants\u00a0;<\/p>\n<p style=\"text-align: left;\">Qu\u2019en statuant ainsi, alors qu\u2019elle avait constat\u00e9 que le r\u00e8glement int\u00e9rieur de l\u2019association\u00a0Baby\u00a0Loup pr\u00e9voit que \u00ab\u00a0le principe de la libert\u00e9 de conscience et de religion de chacun des membres du personnel ne peut faire obstacle au respect des principes de la\u00efcit\u00e9 et de neutralit\u00e9 qui s\u2019appliquent dans l\u2019exercice de l\u2019ensemble des activit\u00e9s d\u00e9velopp\u00e9es par\u00a0Baby\u00a0Loup, tant dans les locaux de la cr\u00e8che ou ses annexes qu\u2019en accompagnement ext\u00e9rieur des enfants confi\u00e9s \u00e0 la cr\u00e8che\u00a0\u00bb, ce dont il se d\u00e9duisait que la clause du r\u00e8glement int\u00e9rieur, instaurant une restriction g\u00e9n\u00e9rale et impr\u00e9cise, ne r\u00e9pondait pas aux exigences de l\u2019article L. 1321-3 du code du travail et que le licenciement, prononc\u00e9 pour un motif discriminatoire, \u00e9tait nul, sans qu\u2019il y ait lieu d\u2019examiner les autres griefs vis\u00e9s \u00e0 la lettre de licenciement, la cour d\u2019appel, qui n\u2019a pas tir\u00e9 les cons\u00e9quences l\u00e9gales de ses constatations, a viol\u00e9 les textes susvis\u00e9s\u00a0;<\/p>\n<p style=\"text-align: left;\"><strong>PAR CES MOTIFS et sans qu\u2019il soit n\u00e9cessaire de statuer sur les autres griefs\u00a0:<\/strong><\/p>\n<p style=\"text-align: left;\">CASSE ET ANNULE, dans toutes ses dispositions, l\u2019arr\u00eat rendu le 27 octobre 2011, entre les parties, par la cour d\u2019appel deVersailles\u00a0; remet, en cons\u00e9quence, la cause et les parties dans l\u2019\u00e9tat o\u00f9 elles se trouvaient avant ledit arr\u00eat et, pour \u00eatre fait droit, les
