style=\"color: #ff0000;\"><strong>principe<\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #ff0000;\"><strong>seule l\u2019absence ou l\u2019insuffisance du plan de sauvegarde de l\u2019emploi soumis aux repr\u00e9sentants du personnel entra\u00eene la nullit\u00e9 de la proc\u00e9dure de licenciement pour motif \u00e9conomique\u00a0<\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #ff0000;\"><strong>la proc\u00e9dure de licenciement ne peut \u00eatre annul\u00e9e en consid\u00e9ration de la cause \u00e9conomique de licenciement, la validit\u00e9 du plan \u00e9tant ind\u00e9pendante de la cause du licenciement\u00a0<\/strong><\/span><\/p>\n<p style=\"text-align: left;\">\n<hr \/>\n<p><em>Demandeur(s)\u00a0: La soci\u00e9t\u00e9\u00a0Viveo\u00a0France<\/em><\/p>\n<p><em>D\u00e9fendeur(s)\u00a0: Le comit\u00e9 d\u2019entreprise de la soci\u00e9t\u00e9\u00a0Viveo\u00a0France<\/em><\/p>\n<hr \/>\n<p style=\"text-align: left;\"><strong>Sur le moyen unique\u00a0:\u00a0<\/strong><\/p>\n<p style=\"text-align: left;\">Vu l\u2019article L. 1235-10 du code du travail\u00a0;<\/p>\n<p style=\"text-align: left;\">Attendu qu\u2019en vertu de ce texte seule l\u2019absence ou l\u2019insuffisance du plan de sauvegarde de l\u2019emploi soumis aux repr\u00e9sentants du personnel entra\u00eene la nullit\u00e9 de la proc\u00e9dure de licenciement pour motif \u00e9conomique\u00a0;<\/p>\n<p style=\"text-align: left;\">Attendu, selon l\u2019arr\u00eat attaqu\u00e9, qu\u2019apr\u00e8s son int\u00e9gration dans le groupe\u00a0Temenos, la soci\u00e9t\u00e9\u00a0Viveo\u00a0France a soumis \u00e0 son comit\u00e9 d\u2019entreprise, en f\u00e9vrier 2010, un projet de restructuration impliquant la suppression de 64 emplois, ainsi qu\u2019un plan de sauvegarde de l\u2019emploi \u00e9tabli \u00e0 cet effet\u00a0; qu\u2019apr\u00e8s avoir pris connaissance du rapport de l\u2019expert qu\u2019il avait d\u00e9sign\u00e9, le comit\u00e9 d\u2019entreprise a engag\u00e9 une proc\u00e9dure de r\u00e9f\u00e9r\u00e9 tendant \u00e0 l\u2019annulation de la proc\u00e9dure de licenciement, dont il a \u00e9t\u00e9 d\u00e9bout\u00e9, puis a saisi \u00e0 jour fixe le tribunal de grande instance, pour qu\u2019il soit jug\u00e9 qu\u2019aucune cause \u00e9conomique ne justifiait l\u2019engagement d\u2019une proc\u00e9dure de licenciement et pour obtenir l\u2019annulation de celle-ci\u00a0;<\/p>\n<p style=\"text-align: left;\">Attendu que pour d\u00e9clarer nulle la proc\u00e9dure de licenciement et tous ses effets subs\u00e9quents, la cour d\u2019appel a retenu qu\u2019en pr\u00e9voyant express\u00e9ment que l\u2019absence de pr\u00e9sentation d\u2019un plan de reclassement, int\u00e9gr\u00e9 au plan de sauvegarde de l\u2019emploi, est sanctionn\u00e9e par la nullit\u00e9 de la proc\u00e9dure, le l\u00e9gislateur a \u00e9dict\u00e9 une sanction qui n\u2019apparaissait pas aller de plein droit car &#8211; sans cette pr\u00e9cision &#8211; l\u2019inobservation de cette obligation eut pu para\u00eetre insuffisante pour vider,\u00a0d\u2019embl\u00e9e, la proc\u00e9dure de son objet et rendre, par l\u00e0-m\u00eame, sans int\u00e9r\u00eat la consultation du comit\u00e9 d\u2019entreprise\u00a0; que tel ne peut \u00eatre le cas, en revanche, d\u2019une proc\u00e9dure engag\u00e9e par l\u2019employeur en l\u2019absence de motif \u00e9conomique v\u00e9ritable, une telle carence vidant de sa substance cette consultation et privant de fondement l\u00e9gal le projet \u00e9conomique du chef d\u2019entreprise\u00a0; que conclure le contraire reviendrait \u00e0 \u00f4ter \u00e0 l\u2019intervention des repr\u00e9sentants du personnel le sens et la port\u00e9e des pr\u00e9rogatives que le l\u00e9gislateur a entendu leur confier\u00a0; qu\u2019une consultation sur un projet pr\u00e9sentant comme existant un motif \u00e9conomique en r\u00e9alit\u00e9 d\u00e9faillant, ne peut caract\u00e9riser une consultation conforme au\u00a0voeu\u00a0du l\u00e9gislateur, lequel aurait manqu\u00e9 \u00e0 la logique la plus \u00e9l\u00e9mentaire s\u2019il avait entendu pr\u00e9voir la nullit\u00e9 de la proc\u00e9dure de licenciement, en cas d\u2019absence de plan de reclassement, sans avoir voulu la m\u00eame nullit\u00e9 lorsque c\u2019est le fondement m\u00eame de ce plan et l\u2019\u00e9l\u00e9ment d\u00e9clenchant de toute la proc\u00e9dure qui est d\u00e9faillant\u00a0; que la lecture de l\u2019article L. 1235-10 du code du travail ne peut donc se faire qu\u2019\u00e0 la lumi\u00e8re, \u00e0 la fois, des r\u00e8gles de droit commun, selon lesquelles pour qu\u2019un acte soit valable il doit respecter les prescriptions l\u00e9gales, et des dispositions particuli\u00e8res r\u00e9gissant, dans le code du travail, les relations du chef d\u2019entreprise et des institutions repr\u00e9sentatives du personnel\u00a0; que le tribunal de grande instance remplit son office en veillant au respect de la loyaut\u00e9 qui doit inspirer ces relations et, au premier chef, le projet de licenciement soumis par le chef d\u2019entreprise au comit\u00e9 d\u2019entreprise\u00a0; qu\u2019en contr\u00f4lant la r\u00e9alit\u00e9 du motif \u00e9conomique, invoqu\u00e9 dans ce projet, il ne s\u2019agit nullement pour lui de s\u2019immiscer dans la gestion de l\u2019entreprise et de porter atteinte \u00e0 la libert\u00e9 d\u2019entreprendre, mais seulement de contr\u00f4ler la l\u00e9galit\u00e9 de la proc\u00e9dure suivie\u00a0; qu\u2019en l\u2019esp\u00e8ce, il r\u00e9sulte du rapprochement de l\u2019analyse des \u00e9l\u00e9ments comptables des soci\u00e9t\u00e9s du groupeTemenos\u00a0et des perspectives de l\u2019avenir commercial des activit\u00e9s de celui-ci que l\u2019activit\u00e9 de ce groupe ne pr\u00e9sente aucune fragilit\u00e9 actuelle ou in\u00e9luctable dans un proche avenir\u00a0; qu\u2019il n\u2019est pas \u00e9tabli que la comp\u00e9titivit\u00e9 du groupe\u00a0Viveo\u00a0France soit actuellement en cause et que, partant, la proc\u00e9dure de licenciement r\u00e9ponde \u00e0 une n\u00e9cessit\u00e9 d\u2019assurer la sauvegarde de cette comp\u00e9titivit\u00e9\u00a0; que le d\u00e9faut de motif \u00e9conomique rendant sans objet la consultation du comit\u00e9 d\u2019entreprise et l\u2019ensemble de la proc\u00e9dure subs\u00e9quente s\u2019av\u00e9rant par l\u00e0 m\u00eame d\u00e9pourvue d\u2019effet, c\u2019est \u00e0 bon droit que le comit\u00e9 d\u2019entreprise de la soci\u00e9t\u00e9\u00a0ViveoFrance sollicite l\u2019annulation de la proc\u00e9dure et de tous ses effets subs\u00e9quents\u00a0;<\/p>\n<p style=\"text-align: left;\">Qu\u2019en statuant ainsi alors que la proc\u00e9dure de licenciement ne peut \u00eatre annul\u00e9e en consid\u00e9ration de la cause \u00e9conomique de licenciement, la validit\u00e9 du plan \u00e9tant ind\u00e9pendante de la cause du licenciement, la cour d\u2019appel a viol\u00e9 le texte susvis\u00e9\u00a0;<\/p>\n<p style=\"text-align: left;\"><strong>PAR CES MOTIFS\u00a0:<\/strong><\/p>\n<p style=\"text-align: left;\">CASSE ET ANNULE, dans toutes ses dispositions, l\u2019arr\u00eat rendu le 12 mai 2011, entre les parties, par la cour d\u2019appel de Paris\u00a0; remet, en cons\u00e9quence, la cause et les parties dans l\u2019\u00e9tat o\u00f9 elles se trouvaient avant ledit arr\u00eat et, pour \u00eatre fait droit, les renvoie devant la cour d\u2019appel de\u00a0Versailles<\/p>\n<hr \/>\n<p style=\"text-align: left;\"><strong>Pr\u00e9sident\u00a0: M.\u00a0Lacabarats<\/strong><\/p>\n<p style=\"text-align: left;\"><strong>Rapporteur\u00a0: M.\u00a0Bailly, conseiller<\/strong><\/p>\n<p
