la condamnation du chef de contrefa\u00e7on<\/strong><\/span><\/p>\n<p style=\"text-align: left;\"><span style=\"color: #ff0000;\"><strong>\u00a0<\/strong><\/span><\/p>\n<p style=\"text-align: left;\">PROPRI\u00c9T\u00c9 INDUSTRIELLE<\/p>\n<h3>Rejet<\/h3>\n<div>\n<p>Propri\u00e9t\u00e9 industrielle<\/p>\n<\/div>\n<ul>\n<li><a href=\"http:\/\/www.courdecassation.fr\/article22172\" data-cke-saved-href=\"http:\/\/www.courdecassation.fr\/article22172\">\u00a0<\/a><\/li>\n<\/ul>\n<hr \/>\n<p><em>Demandeur(s)\u00a0: M.\u00a0R\u00e9ginald\u00a0X&#8230;<\/em><\/p>\n<p><em>D\u00e9fendeur(s)\u00a0: M.\u00a0Louis-Paul\u00a0Y&#8230;\u00a0; La soci\u00e9t\u00e9\u00a0LPG\u00a0Systems<\/em><\/p>\n<hr \/>\n<p><strong>Sur le moyen unique\u00a0:\u00a0<\/strong><\/p>\n<p>Attendu, selon l\u2019arr\u00eat attaqu\u00e9 (Grenoble, 8 juin 2010), que M.\u00a0X&#8230; a \u00e9t\u00e9 condamn\u00e9 au paiement de diverses sommes par un arr\u00eat irr\u00e9vocable du 10 septembre 2001 pour contrefa\u00e7on par reproduction des revendications 1, 3, 4 et 5 du brevet, enregistr\u00e9 sous le n\u00b0\u00a087-03865 et d\u00e9pos\u00e9 par M.\u00a0Y&#8230; qui en avait conc\u00e9d\u00e9 l\u2019exploitation exclusive \u00e0 la soci\u00e9t\u00e9\u00a0LPG\u00a0Systems\u00a0; que ces revendications ayant \u00e9t\u00e9 annul\u00e9es par un arr\u00eat du 21 f\u00e9vrier 2002, irr\u00e9vocable, M.\u00a0X&#8230; a assign\u00e9 M.\u00a0Y&#8230; et la soci\u00e9t\u00e9\u00a0LPG\u00a0Systems\u00a0en restitution de ces sommes\u00a0;<\/p>\n<p>Attendu que M.\u00a0X&#8230; fait grief \u00e0 l\u2019arr\u00eat de le d\u00e9bouter de sa demande, alors, selon le moyen,\u00a0<em>que la d\u00e9cision d\u2019annulation d\u2019un brevet d\u2019invention, qui a un effet \u00e0 la fois r\u00e9troactif et absolu, prive de fondement juridique la condamnation pr\u00e9c\u00e9demment prononc\u00e9e, m\u00eame \u00e0\u00a0l\u2019encontre\u00a0d\u2019un tiers \u00e0 l\u2019instance en annulation, pour contrefa\u00e7on du brevet annul\u00e9\u00a0; qu\u2019elle rend donc indu le paiement fait en ex\u00e9cution d\u2019une telle condamnation, serait-elle irr\u00e9vocablement pass\u00e9e en force de chose jug\u00e9e, et ouvre droit \u00e0 la r\u00e9p\u00e9tition des sommes vers\u00e9es\u00a0; qu\u2019en rejetant la demande de M.\u00a0X&#8230; tendant \u00e0 obtenir la restitution de la somme totale de 6 000\u00a0euros\u00a0vers\u00e9e en ex\u00e9cution des condamnations pour contrefa\u00e7on des revendications 1, 3, 4 et 5 du brevet n\u00b0\u00a087-03865 prononc\u00e9es \u00e0 son\u00a0encontre\u00a0par le jugement du tribunal de grande instance de Limoges du 13\u00a0mars\u00a01997, et confirm\u00e9e par l\u2019arr\u00eat de la cour d\u2019appel de Limoges du 10 septembre 2001, apr\u00e8s avoir pourtant constat\u00e9 l\u2019annulation des revendications pr\u00e9cit\u00e9es par un jugement du tribunal de grande instance de\u00a0Lyon\u00a0du 15 juin 2000, et la confirmation de cette annulation par un arr\u00eat de la cour d\u2019appel de\u00a0Lyon\u00a0du 21 f\u00e9vrier 2002, la cour d\u2019appel, qui n\u2019a pas tir\u00e9 les cons\u00e9quences l\u00e9gales de ses propres constatations, a viol\u00e9 les articles 1235 et 1376 du code civil, ensemble l\u2019article L. 613-27 du code de la propri\u00e9t\u00e9 intellectuelle<\/em>\u00a0;<\/p>\n<p>Mais attendu qu\u2019ayant relev\u00e9 que M.\u00a0X&#8230; avait \u00e9t\u00e9 condamn\u00e9 comme contrefacteur par une d\u00e9cision irr\u00e9vocable, la cour d\u2019appel en a exactement d\u00e9duit que l\u2019an\u00e9antissement r\u00e9troactif et absolu du brevet dans la mesure de l\u2019annulation des revendications prononc\u00e9e par une d\u00e9cision post\u00e9rieure n\u2019\u00e9tait pas de nature \u00e0 fonder la restitution des sommes pay\u00e9es en ex\u00e9cution de sa condamnation du chef de
