D\u2019autres salari\u00e9s n\u2019ayant pas eu le m\u00eame parcours professionnel mais occupant le m\u00eame emploi et percevant une r\u00e9mun\u00e9ration moindre ne sont d\u00e8s lors pas fond\u00e9s \u00e0 soutenir qu\u2019ils auraient \u00e9t\u00e9 victimes d\u2019une in\u00e9galit\u00e9 salariale, en violation du principe pr\u00e9cit\u00e9, par rapport \u00e0 leurs coll\u00e8gues promus vis-\u00e0-vis desquels ils ne sont pas dans une situation identique.<\/strong><\/span><\/p>\n<hr \/>\n<p style=\"text-align: left;\"><strong>Texte de la d\u00e9cision\u00a0:<\/strong><\/p>\n<p style=\"text-align: left;\"><strong>Sur le moyen unique\u00a0:<\/strong><\/p>\n<p style=\"text-align: left;\">Vu le principe &#8220;\u00e0 travail \u00e9gal salaire \u00e9gal&#8221;\u00a0;<\/p>\n<p style=\"text-align: left;\">Attendu que l\u2019article 33 de la\u00a0<em>&#8220;Convention collective nationale de travail du 8 f\u00e9vrier 1957 du personnel des organismes de s\u00e9curit\u00e9 sociale&#8221;, dans sa r\u00e9daction r\u00e9sultant du &#8220;Protocole d\u2019accord du 14 mai 1992 relatif \u00e0 la classification des emplois des organismes de s\u00e9curit\u00e9 sociale et de leurs \u00e9tablissements&#8221;<\/em>, lequel a fait l\u2019objet d\u2019un agr\u00e9ment minist\u00e9riel le 24 septembre 1992 avec effet au 1er janvier 1993, dispose notamment qu\u2019<em>&#8220;en cas de promotion, les \u00e9chelons interm\u00e9diaires d\u2019avancement conventionnel acquis dans l\u2019emploi pr\u00e9c\u00e9dent sont supprim\u00e9s. Les autres \u00e9chelons d\u2019avancement conventionnel acquis sont maintenus, \u00e9tant entendu qu\u2019ils doivent \u00eatre calcul\u00e9s sur la base du nouveau salaire correspondant au nouveau coefficient&#8221;<\/em>\u00a0; que, de son c\u00f4t\u00e9, le Protocole pr\u00e9cit\u00e9, dont le pr\u00e9ambule souligne<em>\u00a0&#8220;qu\u2019une organisation de la gestion des situations professionnelles est mise en place, par la cr\u00e9ation d\u2019un syst\u00e8me de carri\u00e8re se composant de l\u2019avancement conventionnel, du d\u00e9veloppement et du parcours professionnel, pour assurer de nouvelles perspectives de carri\u00e8re aux agents et ainsi reconna\u00eetre l\u2019acquisition de comp\u00e9tences professionnelles, aujourd\u2019hui et demain<\/em>&#8220;, pr\u00e9voit dans son article 3 des coefficients de base et des coefficients de carri\u00e8re, et dans son article 6 relatif \u00e0 l\u2019avancement conventionnel que\u00a0<em>&#8220;lors du passage du coefficient de l\u2019ancienne classification \u00e0 celui de la nouvelle classification, il est proc\u00e9d\u00e9 \u00e0 un red\u00e9ploiement d\u2019\u00e9chelons&#8221;<\/em>\u00a0; que par application de la combinaison de ces dispositions conventionnelles, des agents en fonction dans des organismes de s\u00e9curit\u00e9 sociale, qui avaient \u00e9t\u00e9 reclass\u00e9s le 1er janvier 1993, ont per\u00e7u une r\u00e9mun\u00e9ration moindre que des agents nomm\u00e9s ult\u00e9rieurement dans les m\u00eames fonctions \u00e0 la suite de promotions\u00a0; que Mmes\u00a0X&#8230;, Y&#8230; et Z&#8230;, agents de la CRAMIF, estimant \u00eatre ainsi victimes d\u2019une in\u00e9galit\u00e9 salariale par rapport \u00e0 d\u2019autres coll\u00e8gues promues dans le m\u00eame emploi qu\u2019elles apr\u00e8s le 1er janvier 1993 et ayant conserv\u00e9, conform\u00e9ment aux dispositions des accords collectifs susvis\u00e9s, leurs anciens \u00e9chelons d\u2019avancement plus \u00e9lev\u00e9s que les leurs, ont saisi la juridiction prud\u2019homale de demandes de rappels de salaires correspondant \u00e0 la diff\u00e9rence entre leurs salaires et celui per\u00e7u par la coll\u00e8gue promue ayant la r\u00e9mun\u00e9ration la plus \u00e9lev\u00e9e\u00a0;<\/p>\n<p style=\"text-align: left;\">Attendu que pour condamner la CRAMIF au paiement des rappels de salaires r\u00e9clam\u00e9s, l\u2019arr\u00eat attaqu\u00e9 retient que les dispositions des conventions et accords collectifs de travail ne peuvent faire \u00e9chec au principe &#8220;\u00e0 travail \u00e9gal, salaire \u00e9gal&#8221; et aux dispositions l\u00e9gales qui n\u2019en sont qu\u2019une application et que la discrimination salariale se trouve \u00e9tablie d\u00e8s lors que l\u2019employeur ne justifie des diff\u00e9rences de salaires que par l\u2019application conjointe de la convention collective et du protocole de 1992\u00a0; que l\u2019article 6 du protocole d\u2019accord, en ce qu\u2019il entra\u00eene une diff\u00e9rence de r\u00e9mun\u00e9ration entre salari\u00e9s effectuant un m\u00eame travail, est nul et qu\u2019il convient donc d\u2019accorder aux demanderesses le m\u00eame salaire qu\u2019aux salari\u00e9s qui re\u00e7oivent le salaire le plus \u00e9lev\u00e9 pour le m\u00eame travail\u00a0;<\/p>\n<p style=\"text-align: left;\">Qu\u2019en statuant ainsi, alors que les salari\u00e9es demanderesses n\u2019\u00e9taient pas dans une situation identique \u00e0 celle des agents avec lesquels elles revendiquaient une \u00e9galit\u00e9 de r\u00e9mun\u00e9ration au regard des parcours professionnels sp\u00e9cifiques de ces derniers pris en compte, sans m\u00e9conna\u00eetre le principe &#8220;\u00e0 travail \u00e9gal, salaire \u00e9gal&#8221;, par les accords collectifs, la cour d\u2019appel a viol\u00e9 ce principe\u00a0;<\/p>\n<p style=\"text-align: left;\">Et attendu que la Cour est en mesure, en application de l\u2019article 627 du nouveau Code de proc\u00e9dure civile, de mettre fin au litige en statuant sans renvoi\u00a0;<\/p>\n<p style=\"text-align: left;\"><strong>PAR CES MOTIFS\u00a0:<\/strong><\/p>\n<p style=\"text-align: left;\">CASSE ET ANNULE, dans toutes ses dispositions, l\u2019arr\u00eat rendu le 11 f\u00e9vrier 2003, entre les parties, par la cour d\u2019appel de Paris\u00a0;<\/p>\n<p style=\"text-align: left;\">DIT n\u2019y avoir lieu \u00e0 renvoi\u00a0;<\/p>\n<hr \/>\n<p style=\"text-align: left;\"><strong>Pr\u00e9sident\u00a0: M.\u00a0Sargos<br
