سؤاليي هو بخصوص بعض الجنح مثلا يكون فيها السجن من شهرين الى سنة فيحكم القاضي اما بالغرامة او السجن الموقوف التنفيد على الرغم من العقوبة طبقا للقانون الجنائي تكون مختلفة عن الحكم الدي يقرره القاضي ماهو المرتكز القانوني الدي يعتمده القاضي في اصدار حكمه

يمكن للقاضي منح ظروف التخفيف و ذلك بان ينزل عن الحد الادنى المقرر قانونا للجريمة متى تبين له ان العقوبة المقررة قاسية بالنسبة ...
