رفع اليد من طرف البنك على منزل موضوع قرض توفي صاحبه

توفي اب قبل اكتمال اقساط قرض عقاري لاقتناء منزل. سددت شركة التامين الاقساط الباقية بعد الوفاة لكن البنك يرفض رفع اليد عن الرهن المقيد على المنزل بدعوى ان شركة التامين لم تسدد المبلغ كاملا فرفعت دعوى ضد البنك اطالب فيها بمنحي رفع اليد لكن البنك طالب بالمبلغ الباقي مع ارباح اضافية تم احتسابها منذ تاريخ الوفاة الى اليوم كما ينفي التوصل بشهادة الوفاة فامر القاضي باجراء خبرة. هل يحق للبنك فعلا مطالبتي باداء مبالغ وارباح ناتجة بعد الوفاة بدعوى عدم توصلها او علمها بالوفاة علما ان شركة التاميين تقر بدفع جميع الاقساط الناشئة والمتبقية مباشرة بعد الوفاة. افيدونا جازاكم الله خيرا
