كيف ألغي عقد جراء مسجل من طرف موثق

السلام عليكم ورحمة الله وبركاته نحن 3 أشخاص أنشأنا شركة وقمنا باتفاق شفوي مع مسير من أجل تسيير المحل فقمنا بكراء محل واشترطت صاحبته إبرام العقد لدى موثق. لكن المسير لاحظنا أنه لا يناسبنا فغيرناه وغيرنا الشركة كلها وأردنا فسخ عقد الكراء لإنشاء واحد آخر جديد فتفاجأنا أن الموثق طلب 1500 دم للفسخ و 1500دم لإبرام الآخر فهل يمكن أن نفسخه بأنفسنا أم لابد من الموثق علما أن العقد مسجل وشكرا.

لابد من فسخ عقد التسيير امام السيد الموثق ولكن بعد توافر امرين اثنين في نظرنا وهما

- ان يكون العقد المذكور مقيدا بالسجل المعني.

- ان يكون هناك شرط اتفاقي على ...
