removal of blacklist in Saudi Arabia

إداري
سُئل
My wife has a blacklist in Saudia. She did not go to court or see a judge or get any legal documents. Maybe she was accused of absconding, we don't know. She was deported in 2012 from prison without trial. She was innocent. She then went to UAE and worked for many years until 2022 when she tried to renew her work visa, but was refused. Now we need to remove this blackllist in Saudia. Please help.

Your case is quite complex and definitely requires a legal intervention. Below are the relevant Saudi Arabian laws and regulations that can be invoked in such a case:

1. **Law of Procedure before Sharia Courts**: As per this law, everyone accused has the right to a fair trial and defense hence, your wife being deported without a trial contradicts this right.

2. **Saudi Labour Law**: Article 61 states that if the worker, without any valid reason, is absent from work for more than 20 non-consecutive days in the course of one year or for more than ten consecutive days provided that the dismissal was preceded by a written warning from the employer to the worker if the absence was for ten days in the first case and five days in the second.

3. **Deportation procedures**: Usually, in cases of deportation, the individual is blacklisted from re-entry, however, the procedure or justification for her deportation needs to be well defined.

4. **Revision of Blacklistaed Status**: Saudi Arabian immigration laws do have provisions for revising a person's status after deportation but the reasons for the initial deportation are considered and evaluated in such proceedings.

Given the intricacies involved in your case, the best course of action would be to engage with a legal professional who has experience in Saudi Immigration Laws and can guide you through the process. Your lawyer can contact the Saudi Embassy to get the exact reasons for the blacklisting and then work towards rectifying the situation.
