Saudi Arabia follows the Islamic Sharia law, and according to this law:
1. Child Custody: The mother usually gets custody of the children until they reach a certain age (boys until age 7 and girls until they get married). This is based on the Hadith of Prophet Muhammad (Peace Be Upon Him), “No mother should be separated from her child but with her will.” Although the mother has custody, the father still bears the legal responsibility of the children's upbringing.
2. Alimony: According to Article 18 of the Law of Procedure before Sharia Courts, a Saudi man has to provide financial support for his divorced wife until the end of the waiting period (iddah, which is a period of 3 menstrual cycles or until childbirth if she is pregnant). The alimony includes food, clothing, housing, and medical treatment costs.
3. Maintenance for Children: As per Article 134 of the Saudi Labor Law, the Saudi father is obligated to provide financial support to his children, irrespective of where they live. This includes ensuring they are given food, clothing, housing, and access to education.
4. Division of Assets: This depends on what has been agreed upon between the couple. Generally, each party would retain what's legally theirs unless there's a/pre nuptial agreement suggesting otherwise.
5. Right to Stay in Saudi Arabia: Usually, an expat woman can continue living in Saudi Arabia after divorce until her Iqama (residence permit) expires. Beyond that, she might need a new sponsor to extend her stay.
