Dear Shyamal Das,

I am sorry to hear about your challenges at work. As per Saudi Labor Law, Article 109, each worker is entitled to 21 days paid annual leave after the completion of one year of employment and it becomes 30 days from the subsequent years. If you have already served more than a year, then as per Saudi Labor Law, you are entitled to take this leave.

The law states that "The worker shall have the right to a paid annual leave and he may not give up such right. Upon the worker's request, the employer may defer the leave for a year. The employer may also, at the request of the worker, spread the leave over the year."

However, the specific timing of when this leave is granted is usually subject to agreement between the employer and the employee. If your employer is refusing to grant you leave in your time of need, it may be worth seeking a discussion with them, explaining your personal circumstances and requesting to use your entitled leave days.

I suggest you have a direct conversation with your HR department to clarify your rights and work towards an amenable solution. If your employer is still not granting your leave despite having finished more than a year, you might want to consider filing a complaint with the Ministry of Labor and Social Development.

Remember, it is important that you maintain a courteous and professional approach throughout the process. Stand for your rights, but always through legal and diplomatic means.

Best regards,

[Your Name]
