Question

A unemployed person who lost their job due to a redudancy and cannot back the bank debts and the bank has raised court case , what can be done in this case , there is no other means of income to pay debts because the person has no other source of income , on the other hand the person has no money to have a lawyer and the situation can go to extreme , how can a person be helped in this case , the person family members such as mother and father are also unemployed so they cannot pay the debts on behalf of the person

لايمكن فعل أي شيء لأن الدائن من حقه الحصول على دينه، وبالتالي فإن لجوءه إلى القضاء أمر طبيعي، ويمكن للمدين أن يتمسك أمام المحكمة بمقتضيات المادة 249 من قانون المعاملات المدنية الذي ينص على أنه إذا طرأت حوادث استثنائية عامة لم يكن في الوسع توقعها وترتب على حدوثها أن تنفيذ الالتزام التعاقدي وان لم يصبح مستحيلا صار مرهقا للمدين بحيث يهدده بخسارة فادحة جاز للقاضي تبعا للظروف وبعد الموازنة بين مصلحة الطرفين أن يرد الالتزام المرهق الى الحد المعقول إذا اقتضت العدالة ذلك ويقع باطلا كل اتفاق على خلاف ذلك.
وعليه يمكن الطلب من القاضي إما الزيادة في أجل السداد أو تخفيض مبلغ القسط.
و أنه وإن  تم إلغاء مقتضيات المادة 324 من قانون الإجراءات المدنية التي كانت تنص على أن لقاضي التنفيذ أن يصدر أمراً بناء على طلب يقدم من المحكوم له، بحبس المدين، إذا امتنع عن تنفيذ حكم نهائي أو أمر أداء نهائي رغم ثبوت قدرته على الوفاء، أو خشية هربه من البلاد، ولا يعتبر المدين مقتدراً على الوفاء إذا قامت ملاءته كلية على أموال لا يجوز الحجز عليها أو بيعها، إلا أنها استبدلت بنص المادة 183 من قرار مجلس الوزراء رقم 57 لسنة 2018 وتتضمن نفس المقتضى الذي يسمح لقاضي التنفيذ بحبس المدين لمدة شهر قابلة للتجديد لمدد أخرى لا تتجاوز ستة أشهر إذا كان المدين ممن لا يخشى هربه من الدولة، كما يمكن لقاضي التنفيذ تقسيط المبلغ المنفذ على ثلاث سنوات أو منح المدين مهلة لا تجاوز ستة أشهر.

And that, if the requirements of Article 324 of the Civil Procedure Code were stipulated, which stipulated that the execution judge may issue an order based on a request submitted by the convict, with the imprisonment of the debtor, if he refuses to implement a final ruling or a final performance order despite its proven ability to fulfill, or For fear of escaping from the country, the debtor is not considered able to pay if his solvency is based on funds that cannot be seized or sold, except that it has been replaced by the text of Article 183 of Cabinet Resolution No. 57 of 2018 and includes the same requirement that the execution judge is allowed to imprison the debtor for a period of one month. To renew for periods that do not exceed six months if the debtor is among those who are not afraid to flee the state, and the execution judge can install the amount executed for three years or give the debtor a period not exceeding six months.
