عقد سلف بين طرفين لضمان منزل

السلام عليكم و رحمة الله أقرضت شخصا مبلغا من المال بضمان محل سكنه وفق عقد عرفي بين طرفين مصادق عليه بمكتب تصحيح الإمضاء ، و بعد انتهاء المده المتفق عليها بشهر لم يرجع لي المال الذي أقرضته و بدأ في المماطلة . هل أرفع عليه دعوة قضائية ؟ و هل في هذه الحالة ستقوم المحكمة بالحجز على سكناه ؟ افيدوني جزاكم الله خيرا فإني على عجلة من أمري و أخاف ألا أسترجع مالي بسبب انتهاء العقد و بارك الله فيكم
