My company finally allowed me to sign for a refuse-to-work after my 6 months working. From the HR, they didn't tell me the consequences. And now, they sent me back to the agency. From the agency, they told me that since I refused to work, I have to exit Saudi Arabia and pay my company 16k SR, for they explained further, because I was directly hired by my company from country origin and my agency is just like a middleman. I asked if there would be another option such as if they could just find me another client or if they couldn't find me, I myself will look for another, so that I can pay the said amount. They said, it's totally dead-end, no other options other than paying them and going back to my country. And now, I'm stuck in my agency's accommodation doing nothing and I will be running out of money to buy my own food. Please I need your advice on what I will do... And I want to know my rights. Shukran

I'm sorry to hear about your situation. Here is some legal advice based on the Saudi Arabian Labour Law.

According to Article 60 and Article 61 of Saudi Labor Law, it states that:

"Article 60: In all cases where the work contract is revoked, the employer may not require the worker to leave the Kingdom before he can receive all the wage to which he is entitled, unless the worker will not go to the competent Commission. Furthermore, the employer may not prevent the worker from moving to another employer in accordance with the provisions of this Law."

"Article 61: If the term of the worker’s stay in the Kingdom ends before the work contract is terminated, the employer shall, at his expense, extend the term of the worker’s stay to the date of expiration of the contract."

This means that if you have signed a refuse-to-work agreement, your employer should extend your stay until the end of your contract at their expense. Furthermore, you cannot be forced to leave Saudi Arabia without being paid all of your wages.

As per Article 77, it states:

"Article 77: If the term of the contract expires and the parties continue to implement it, it shall be considered renewed for an indefinite term on the same conditions contained therein."

This means, even if you initially refused to work further after the expiration of your term, as long you and your employer continue to adhere to the conditions of the old contract, it is considered renewed.

However, it's unclear if a refusal-to-work agreement makes exceptions to these rules. You might want to consider contacting a legal expert in Saudi Arabia to get detailed advice on your situation.

Please note this advice is based on the Saudi Arabian Labour Law and might not cover all aspects of your situation. It's always advisable in legal matters to get personalized advice from a legal professional.
