Wa Alaikum As Salaam. Under the KSA Labor Law, specifically, Article 74 provides that "The non-Saudi worker may transfer his sponsorship to another employer if a year has passed since the date of his last entry into the Kingdom."
According to the Qiwa platform, when a termination process is initiated by either the employer or employee, a notice period is required as agreed upon in the contract. Both parties must fulfill the requirements of the notice.
If your employer doesn't provide a release, under Article 77 and 78 of the Labor Law, you have the right to file a complaint with the Labor Office. The labor office may allow transfer if the employer fails to provide necessary documentation, payments, or any other obligations as stipulated in the Labor Law.
Remember, once the notice period is fulfilled, and assuming that you've fully complied with all legal requirements related to your termination, your employer should not unreasonably withhold the release.
However, labor disputes can sometimes be complex, and legislation might be subject to interpretations. Therefore, it is crucial to ensure you have sought all necessary advice and have completely understood all potential consequences and responsibilities. To ensure that you are in full compliance with the law, you could consider discussing your situation with the local labor office or a legal advisor.
