في هده النازلة هل قرار محكمة الاحالة يعتبر باطلا ام قانونيا

السلام عليكم بعد نقض محكمة النقض قرار محكمة الاستئناف واحالة القضية من جديد لمحكمة الاستئناف لنظرفيها وفق القانون و بهيىئة قضائية اخرى و بعد حكم محكمة الاحالة و اصدار قرارها . و بعد تسلمي لنسخة من القرار اتضح لي بان احد القضاة الموقع على هدا القرار بصفته عضوا كان قد شارك في القضية ابتدائيا فهل الحكم يعتبر في هده النازلة باطالا ام ان القرار صدر قانونيا لان المنع يخص القضاة الدين شاركوا في اصدار القرار موضوع النقض فقط و ليس غيره من الاحكام كما ينص على دالك الفصل 369 من قانون المسطرة المدنية .و شكرا على الجواب.
