إفراغ محل تجاري للمصلحة شخصية

سلام عليكم لقد إكترى والدي محل تجاري مند ازيد من 40 سنة بسومه كرائيه 400 درهم فشهر .وقد فوجئنا بالكاري يطالب بافراغ المحل للمصلحه الشخصية مع العلم انا لمحل ليس في ملكه الخاص وهوا فقط ينوب عن الورته ليس لديه عقد ملكية المحل مع العلم انه لدي وتيقة تتبت انه ينوب عن الورتا فيلحصول على سوما الكرائيه فقط .فهل لديه الحق في رفع دعوة الإفراغ للمصلحة الشخصية .وهل يمكن إبطال تلك دعوة ؟؟
