Regarding Pending Full and Final Settlement and Unresolved Undertaking Request
I have a complaint against my former employer, Testcrew, regarding their failure to settle my Full & Final settlement (F&F) and the unreasonable request to sign an undertaking, which remains unresolved despite my constant follow-ups.
I resigned from my position at Testcrew two months ago,. My last working day was 31st December 2024 and as of today, my Full & Final settlement, including my salary for the last two months (November 2024 and December 2024), remains unpaid. I have made several attempts to reach out to the HR department for clarification and resolution, but unfortunately, I have not received any concrete response or update on this matter.
Firstly, On 15th January 2025, I received a FNF document from Testcrew for review and signature. However, the document contained an error as it only mentioned 26 days' salary instead of the two full months which were pending. I requested them to review the FNF settlement and provided email proof of my last working day and pending salaries. Despite my efforts to follow up, I did not receive any response until 18th February 2025.
On 18th February 2025, Testcrew contacted me again and asked me to sign an undertaking stating that I shall not work with the last client which i was working with during my tenure, either directly or indirectly. I am confused as to why I was asked to sign such a document, especially when it was not disclosed to me during my exit interview or at any point during my employment. Moreover, they insisted that signing the undertaking was necessary to complete the FNF procedures, a requirement that was never communicated to me before. Also they mentioned that After signing the undertaking, they will still take 30-60 days for the payment to be cleared.
Since the 18th of February, I have repeatedly requested an explanation regarding the need for the undertaking, as well as clarification on why I was not informed about this requirement earlier. Despite my repeated attempts, hey have completely stopped responding to my inquiries.
I am deeply disappointed with the lack of professionalism and transparency shown by Testcrew, and I believe this situation is unfair. Not only has my Full & Final settlement been unjustly delayed, but I am also being put under unnecessary pressure to sign an undertaking that was never communicated to me earlier.
I kindly request your suggestion how to take this forward and what can i do to get my fnf.

Regarding the undertaking, the Saudi Labor Law in its Article 83 prohibits employers from preventing a worker (whether during the work relation or on its termination) from joining any other employer unless the worker has undertaken in writing not to compete with the employer or not to divulge any industrial or trade secrets related to the activity of the establishment and that for the period and within the limits allowed by article (83) of this law.
If your employer's request for non-compete and non-disclosure of trade secrets was not included in your employment contract, you may challenge it as per Article 83.
In order to proceed, you may lodge a complaint against your employer with the Ministry of Labor and Social Development for non-payment of your final settlement as well as for the unreasonable request of signing an undertaking. The Ministry would initiate an investigation against the employer for the alleged violations.
I'd also advise you to collect all the documents, emails or other evidence like screenshots of your conversations that you have to support your claims. These will be valuable in the process of your complaint.
Also, do bear in mind to consult with a Legal expert or a Lawyer specializing in Labour Law in order to ensure that your rights are fully protected throughout this process.
